To make sure your personal information is secure, we communicate our privacy and security guidelines to all SBCC team members and strictly enforce privacy safeguards within the company. Definition
1.1 “Personal data” is any information that enables us to identify you, directly or indirectly, such as your email address, name, shipping and billing address, telephone number, financial information, user names, any form of identification number or one or more factors specific to your physical, physiological, mental, economic, cultural or social identity.
1.2 “GDPR’ means (a) the Regulation (EU) 2016/679 of the European Parliament and the Council of 27 April 2016 on the protection of natural persons with regard to the Processing of Personal Data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation), and (b) the United Kingdom General Data Protection Regulation. The data controller of SBCC is FBTriangle Inc. corporation, with the principal place of business in Tokyo, Japan.
1.3 "Services" means any product or service provided by SBCC pursuant to SBCC’s Terms of Use.
1.4 “Subscriber” means a Customer subscribes to our Services.
1.5 “Sites” refers to sunbear.com, sunbears.jp, and admin.sunbears.com, and their subdomains.
1.6 “You,” “your,” and “yours” refer to the user.
2. Information SBCC process
Our comprehensive sports team toolset includes PC software, a Progressive Web Application (PWA), and a Playback app for real-time sports game recording. Engaging with our platforms—whether through Sites, PC software, PWA, or the Playback app—entails collecting various information types to enhance your experience and fulfill our service commitments. This collected information falls into categories such as "Access Information," "Contact Information," and "Third-party Information."
2.1 Access Information:
2.1.1 Device and Network Data: To optimize service across platforms (PC software, PWA, Playback app), SBCC collects information about your device and network, including geographic location, IP address, operating system, browser type, device type, and bandwidth. This data aids in system administration and service improvement.
2.1.2 User Engagement Metrics: Monitoring interactions with our services—like site visit duration, pages viewed, and access times—helps us enhance usability and content relevance. Alone, this data is non-identifying but may become personal data when combined with other information.
2.1.3 Cookie and Technology Use for Enhanced User Experience:

2.3 Third-party Information/Collaboration and Data Acquisition: Partnering with external entities enhances our service offerings through additional data collection. Additionally, data related to user interactions with the AI Completion Tool is collected to improve its functionality and user experience. 2.5 Sunbears includes an AI Completion Tool to assist users with input across various fields, such as player information, team details, planning notes, and schedules. While designed to streamline tasks and enhance user experience, the AI tool operates as a supportive feature and has certain limitations. Users are advised to verify AI-generated content for accuracy, especially in critical contexts.
In this regard, please note:
Output Reliability: The AI’s output is generated automatically and has not undergone independent verification. As such, Sunbears does not warrant the accuracy, completeness, or reliability of AI-generated content, and the output does not represent the official views of Sunbears.
User Discretion: The AI tool is intended as a helpful assistant, but it cannot replace user judgment. We recommend independent verification of AI-generated information before making decisions based on it.
Privacy and Security: Data provided to the AI Completion Tool is processed within the Sunbears platform, following our privacy and data protection practices as outlined in this policy.
3. Data Access, Deletion, and Notification Procedures
SBCC ensures clear identification of roles within our platform regarding user data access and deletion. Specifically, the Owner, Admin, and Coach roles have the authority to edit and delete team information, even after a team member's departure. This ensures responsible management and control of data access within our system.
Upon cancellation of a team account and add-on package subscription, Sumbears will email all relevant users within 24 hours. This protocol applies equally to re-subscriptions. It's important to note that while data retention for add-ons extends for 6 months, access to the paid add-ons will conclude at the end of the current billing period. SBCC advises users to export their data before this access ends to ensure no loss of valuable information.
4. How we use your personal data
4.1 We use your personal data according to the terms of the Privacy Policy in effect at the time of our use. We will process your personal data where:
you have provided your consent which can be withdrawn at any time;
where the processing is necessary for the performance of a contract to which you are a party or to perform services you have requested;
where we are required by law;
where processing is required to protect your vital interests or those of another person; or
where the processing is necessary for the purposes of our legitimate commercial interests, except where such interests are overridden by your rights and interests.
4.2 Your “Access Information” is used to route the requested web page to your computer or mobile device for viewing. It enables us to provide you with access to our Sites. We use this information in line with our legitimate commercial interests to administer our Sites and for internal operations, including troubleshooting, data analysis, site analysis, testing, research, statistical and survey purposes, to improve our Sites, to ensure that content is presented in the most effective manner for you and for your device, to allow you to participate in interactive features of our services, when you choose to do so, as part of our efforts to keep our Sites safe and secure; to measure or understand the effectiveness of advertising we serve to you and others, and to deliver relevant advertising to you, and where you have provided your consent, to make suggestions and recommendations to you about goods or services that may interest you.

As such, it may enable us or our selected partners to contact you, for example, to respond to a query you have submitted to us. In the event that you are given (or where you have chosen) a password that enables you to access certain parts of the Sites, you are responsible for keeping this password confidential. SBCC may use anonymized data from injury assessments and related surveys provided through the platform for epidemiological research aimed at improving sports safety and understanding injury trends. 5.1 Where necessary, we will share your personal data for the purposes described in this privacy policy with:
members of our group, which means our subsidiaries, our ultimate holding company, and its subsidiaries;
business partners, suppliers, and sub-contractors who require access to personal data to assist in the performance of any contract we enter into with them or you;
trusted third-party companies and individuals to perform functions in certain situations on our behalf. These functions include cloud storage providers, email services, providing marketing assistance and data analysis, handling transactions, fulfilling orders, and providing customer service and credit referencing. These agents have access to the personal data required in order to perform their functions but may not use it for any other purpose, and
analytics and search engine providers assist us in the improvement and optimization of our Site.
5.2 For personal data from the European Union or the European Economic Area (the “EEA”):
5.2.1 We will only transfer your personal data to trusted third parties who provide sufficient security guarantees and who demonstrate a commitment to compliance with applicable law and this privacy policy.

6.1 There is no legal requirement for you to provide any information at our Sites. However, our Sites will not work without certain “Access Information" described above. Failure of your browser to accept “cookies” will not prevent your use of our Sites but may prevent certain features from working.
6.2 For any “Contact Information” that is requested on a Site, failure to provide the requested information will mean that the particular feature or service associated with that part of the Site may not be available to you.
7. How long your data is stored
SBCC uses Google's infrastructure to host the Sunbears platform, ensuring high standards of data security and compliance with GDPR, irrespective of where the servers are located. This approach guarantees that personal data handling meets rigorous privacy standards, particularly for our services in the EU market.
We retain your personal data for as long as necessary to achieve the purposes for which it was collected. This duration encompasses the time needed to comply with legal, accounting, and reporting requirements, resolve disputes, and enforce our agreements. For users with paid add-on packages, SBCC implements a 180-day retention period after subscription cancellation. During this period, your data is automatically archived, allowing you to resume activities seamlessly if you decide to return. The archiving and management of this data can be adjusted via the Firebase Console, providing flexibility and control over your information.
Data from Sunbears Freemium (free accounts) is automatically deleted after 90 days of inactivity to ensure responsible data management in line with data protection principles. Additionally, in certain cases such as compliance with legal obligations or for security investigations, data may be retained longer than the typical periods.
Once the designated retention period ends, SBCC ensures that your data is either securely deleted or anonymized, rendering it irretrievable and thereby safeguarding your privacy.
8. Safety of your information
8.1 Data Transmission and Security Measures: SBCC understands that the transmission of information over the Internet cannot be guaranteed to be entirely secure. While SBCC cannot eliminate the risk associated with data transmission to our Sites, SBCC is committed to implementing robust technical and organizational measures to protect your personal data against unauthorized access, alteration, disclosure, or destruction. These measures include:
Encryption: Utilizing strong encryption for data in transit and at rest, ensuring that your personal information is protected against interception and unauthorized access.

9.1 For individuals within the EEA only. Under the GDPR, in certain circumstances, you have the right to (a) request access to any personal data SBCC holds about you and related information, (b) obtain without undue delay the rectification of any inaccurate personal data, (c) request that your personal data is deleted provided the personal data is not required by us for compliance with a legal obligation under European or Member State law or for the establishment, exercise or defense of a legal claim, (d) prevent or restrict processing of your personal data, except to the extent processing is required for the establishment, exercise or defense of legal claims; and (e) request transfer of your personal data directly to a third party where this is technically feasible.

12. Children under 16
The Sites are not intended for children under 16 years of age. No one under age 16 may provide any information to or on the Sites.
